3-Day Notice to Perform Covenant or Quit

The 3-day notice to perform covenant or quit requires the tenant who has violated a lease or rental agreement provision to correct the problem (perform covenant) or move (quit) within three days. For example, if the tenant’s lease forbids pets, this type of three-day notice requires the tenant to get rid of her pet or move within three days.

  • If the tenant does correct the problem within the three-day period, the tenancy continues.
  • If the tenant does not correct the problem within three days, the landlord may bring an eviction lawsuit.

With a conditional Three-Day Notice to Perform Covenant or Quit, don’t accept any rent unless the tenant has corrected the violation within three days— if you do, you can’t evict and the tenant can stay. Accepting the rent is a legal admission that you decided to forgive the violation and continue collecting rent rather than deal with the problem.
